Description
[66 Cal2d Page 109] MOSK, J. Defendant appeals from a judgment of conviction entered upon a jury verdict finding him guilty of unlawful possession of narcotics. (Health & Saf. Code, § 11500.) Defendant's principal contention is that he was convicted on evidence unlawfully obtained in a search of his car after it had been towed from the scene of the arrest to a police parking lot, citing Preston v. United States (1964) 376 U.S. 364 [11 L.Ed.2d 777, 84 S.Ct. 881], and People v. Burke (1964) 61 Cal. 2d 575 [39 Cal. Rptr. 531, 394 P.2d 67]. As will appear, we have concluded that those decisions are distinguishable on their facts and that the search here conducted was not ""unreasonable"" [66 Cal2d Page 110] within the meaning of the constitutional guarantees (U.S. Const., 4th and 14th Amends.; Cal. Const., art. I, § 19).
