Defendant, Anthony Cunningham, appeals the judgment of conviction entered by the Denver District Court of guilty to first degree sexual assault. Defendant, who was seventeen at the time of the conviction, contends that the district court erred when it denied his motion to dismiss made prior to his entry of the plea. The motion alleged that the district court lacked jurisdiction under § 19-1-104(4)(b)(II), C.R.S. 1973 (1978 Repl. Vol. 8) because defendants prior delinquency adjudication was void. We disagree and, therefore, affirm.
